Terms of Service
Effective: April 17, 2026 · v1.0
Effective: April 17, 2026 · v1.0
By accessing or using Skybrari, including the website at skybrari.com and any associated services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the service.
These Terms apply to everyone — buyers, photo-review submitters, gallery submitters, contest entrants, and general visitors.
Skybrari operates a library of panoramic sky photographs captured in-camera by a single photographer. The service includes:
Some features require an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify hello@skybrari.com immediately if you believe your account has been compromised.
One account per person. Accounts are non-transferable.
All sky file purchases are governed by the Skybrari Personal-Use License Agreement, included inside every purchased zip and available at skybrari.com/license. The License grants a non-exclusive, non-transferable, worldwide, perpetual right to use sky files in your own photographic composites, including paid commercial photography work.
Prohibited uses include but are not limited to:
The full list of prohibitions is in the License Agreement. Violation terminates the license automatically.
When you submit a before/after pair to the public gallery, you grant Skybrari a non-exclusive, worldwide, royalty-free right to display, reproduce, and promote your submission on skybrari.com, Skybrari social media, and in Skybrari marketing materials. You retain ownership of your work.
You represent that you hold the rights to the original photograph you submit, or have documented permission from the rights holder.
Skybrari moderates all submissions and may reject any submission for any reason, including inappropriate content, poor technical quality, rights concerns, or AI-generated base imagery.
Weekly challenges are open to any account holder worldwide. Contest winners are determined by community vote, with ties broken by earliest submission time. Skybrari reserves the right to disqualify entries that show signs of vote manipulation. Prizes (sky files, credits, featured homepage spots) are awarded as described at skybrari.com/contest.
Promo codes (including referral codes) are single-use per customer unless otherwise stated. Skybrari may revoke promo codes that appear on coupon-aggregator sites or are otherwise abused.
You agree not to:
All original sky photographs, the skybrari.com website design, and all Skybrari branding, copy, and code are the property of Skybrari or its licensors. Your purchase grants usage rights as described in the License Agreement — it does not transfer ownership of the underlying photographs.
The name "Skybrari" and the sunset-gradient logo mark are trademarks of Skybrari.
Skybrari is provided on an "as-is" and "as-available" basis. Skybrari makes no warranties, express or implied, regarding the service's fitness for any particular use, availability, accuracy, or reliability. Sky files are sold as panoramic JPGs; while every effort is made to ensure technical quality, the Licensee is responsible for determining fitness for a given composite.
To the maximum extent permitted by law, Skybrari's total liability under these Terms — in contract, tort, or otherwise — is capped at the greater of USD $100 or the total amount you paid Skybrari in the 12 months preceding the event giving rise to the liability. Skybrari is not liable for indirect, incidental, consequential, punitive, or special damages.
Skybrari may suspend or terminate your account at any time for material breach of these Terms or the License Agreement, including attempted resale, redistribution, or AI-training use of sky files. On termination, your right to use any purchased sky files continues, subject to the License Agreement, unless termination is specifically due to License violation.
These Terms may be updated to reflect new features, service providers, or legal requirements. Material changes will be communicated by email to active account holders and posted at skybrari.com/terms with a revised effective date. Continuing to use the service after the effective date of a change constitutes acceptance.
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-laws principles. Any dispute arising under these Terms shall be brought in the state or federal courts located in Palm Beach County, Florida, and both parties consent to personal jurisdiction in those courts.
